These Terms of Service ("Terms") govern your use of BrainGym (the "Service"), available at braingym.uk and associated web applications. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is currently in beta. Features may change, be added, or be removed without notice. The Service may be unavailable, interrupted, or contain errors. Scores, streaks, and other data may occasionally be recalculated or reset as we improve the platform. We will make reasonable efforts to preserve your data but cannot guarantee it during the beta period.
BrainGym is a mental fitness and performance platform. It provides cognitive exercises, self-tracking tools, and habit protocols relating to cognitive training, sleep, and nutrition.
BrainGym is not a medical device or a medical, psychological, or diagnostic service. Scores and metrics in the Service (including the Brain Score and pillar scores) are engagement and training measures, not clinical assessments. They do not diagnose, treat, or predict any medical or psychological condition. Nothing in the Service constitutes medical, health, or nutritional advice. Consult a qualified professional before making health decisions, and do not disregard professional advice because of anything in the Service.
You must be at least 18 years old to use the Service. You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it up to date. We may suspend or terminate accounts that breach these Terms.
New users receive a free trial (currently 3 months for Founding Athletes; trial length may differ for later cohorts). No payment details are required during the trial. After the trial, continued access to some or all features may require a paid subscription. We will give you reasonable notice before any charge applies, and we will never charge you without you actively providing payment details and confirming a subscription. Pricing is subject to change; changes will not apply retroactively.
You agree not to: misuse, disrupt, or attempt to gain unauthorised access to the Service; use automated means to access or manipulate scores or leaderboards; upload unlawful or harmful content; reverse-engineer the Service; or use the Service to build a competing product.
You retain ownership of the personal information you provide. You grant us a licence to store and process your training data (exercise results, check-ins, scores) to operate the Service. We may use aggregated, anonymised data (data that cannot identify you) to improve the Service, calibrate scoring, and build benchmarks and comparative features. See our Privacy Notice below for how we handle personal data.
Where leaderboards or comparative features exist, your display name and scores may be visible to other users. Where a visibility setting exists, you can opt out. We may remove any name, entry, or content we consider inappropriate.
The Service, including its design, branding, exercises, scoring systems, and content, is owned by BrainGym or its licensors. We grant you a personal, non-transferable, non-commercial licence to use the Service. "BrainGym", the BrainGym logo, Collective names, and "Brain Score" are our trade names and may not be used without permission.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. To the maximum extent permitted by law, BrainGym will not be liable for indirect or consequential loss, loss of data, or loss of profits arising from use of the Service. Our total aggregate liability in connection with the Service is limited to the greater of £100 or the amount you have paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud).
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, or discontinue the beta with reasonable notice. Sections 3, 7, 9, 10, and 13 survive termination.
We may update these Terms from time to time. We will post the updated version with a revised date, and, for material changes, notify you in the Service or by email. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer law in your country of residence provides otherwise.

This notice explains how BrainGym handles your personal data, in line with UK GDPR.
Account details (name, email); your chosen Collective and profile settings; training data (exercise results, reaction times, check-in answers, scores, streaks); and basic technical data (device/browser information) needed to run the Service.
To provide the Service and your account (contract); to maintain, secure, and improve the Service, including calibrating scoring and building anonymised benchmarks (legitimate interests); and to send you service updates and, with your consent, marketing you can opt out of at any time.
The Service is built and hosted on Base44, whose infrastructure processes data on our behalf. When you create an account, your email address, name, Collective, and age range are also shared with MailerLite, our email platform, so we can send you service and onboarding emails; every such email includes an unsubscribe link, and unsubscribing does not affect your account. We do not sell your personal data.
We use essential storage on your device to keep you signed in and to run the Service (for example, remembering your Collective choice during onboarding). This is strictly necessary and does not require consent. With your consent, given via the cookie banner, we also use Google Analytics and Contentsquare to measure how the Service is used, and the Meta (Facebook) Pixel to measure the performance of our advertising. These set cookies and share limited technical data with Google, Contentsquare and Meta Platforms respectively. If you choose "Essential only", none of them load and nothing is shared. You can change your choice at any time:
While your account is active. If you delete your account or ask us to, we will delete your personal data within 30 days, except where we must retain it by law. Aggregated, anonymised data may be retained.
You can request access to, correction of, or deletion of your personal data, object to or restrict processing, and request portability. Contact louis@braingym.uk. You can complain to the UK Information Commissioner's Office (ico.org.uk).
The Service is not intended for anyone under 18.
